Refund and Dispute Policy

VisionaryAI Inc. (“VisionaryAI,” “we,” “us,” or “our”) may charge fees for marketing, lead-generation, intake, screening, coordination, referral, introduction, consultation, or related platform services. Unless expressly stated otherwise in a separate written agreement signed by VisionaryAI, any payment made to VisionaryAI is payment for VisionaryAI’s own services only and not for the services, products, treatment, work, scheduling, performance, or outcomes of any third party to whom a user may be introduced, referred, or connected.

VisionaryAI does not provide the underlying third-party service unless expressly stated in writing. For example, if we introduce a user to a contractor, dentist, clinic, consultant, or other independent provider, VisionaryAI is not responsible for that third party’s availability, conduct, performance, pricing, timeline, cancellation, refusal to accept the project, quality of work, treatment outcome, communications, or any dispute arising from that relationship. Any charges paid directly to a third party are strictly between the user and that third party and are not refundable by VisionaryAI.

1. Disputes Must Be Raised Within 30 Days

If you believe that a charge billed by VisionaryAI should be disputed because the specific VisionaryAI service you purchased was not provided, you must submit a written dispute request within thirty (30) days of the original charge date.

Disputes submitted after that 30-day period may be denied.

Your request should include enough detail for us to identify the transaction and investigate the issue, including your name, contact information, date of payment, amount paid, service requested, and the reason for the dispute.

2. Investigation Period

Upon receiving a timely dispute request, VisionaryAI may take up to ninety (90) days to review, investigate, validate, and make a determination regarding the request.

During the investigation period, VisionaryAI may request additional information, documents, screenshots, communications, confirmations, or other supporting materials. Failure to provide requested information may result in denial of the dispute.

Submitting a dispute request does not automatically entitle a user to a refund, reversal, chargeback approval, or any interim credit.

3. When a Refund May Be Issued

A refund may be issued only if VisionaryAI determines, in its sole reasonable judgment, that:

  • the user paid VisionaryAI directly;
  • the dispute was submitted within the required 30-day period; and
  • the specific service paid for from VisionaryAI was not provided at all.

If these conditions are met, VisionaryAI’s maximum obligation is limited to refunding the amount actually paid by the user to VisionaryAI for that specific unprovided service.

4. No Refunds in Certain Cases

Without limiting any other provision of our Terms, refunds will generally not be issued where:

  • VisionaryAI provided the paid introduction, referral, screening, coordination, consultation, or related service;
  • the dispute relates to dissatisfaction with a third party’s service, treatment, workmanship, scheduling, availability, pricing, bedside manner, professionalism, communications, or results;
  • the user changed their mind after VisionaryAI performed the requested service;
  • the user failed to respond, failed to attend, failed to cooperate, or failed to follow through after the introduction or coordination was made;
  • the request concerns charges paid to a third party rather than to VisionaryAI;
  • the request is incomplete, unsupported, inaccurate, or fraudulent; or
  • the dispute was submitted after the 30-day deadline.

5. Third-Party Charges Are Not Refundable by VisionaryAI

VisionaryAI is not responsible for refunding, reversing, or reimbursing:

  • fees paid to contractors, dentists, clinics, consultants, lenders, financing providers, or any other third party;
  • deposits paid to any third party;
  • treatment fees, construction fees, cancellation charges, financing charges, subscription fees, materials costs, or project costs charged by any third party; or
  • indirect, incidental, consequential, or out-of-pocket losses arising from a user’s relationship with any third party.

Any request relating to third-party charges must be directed to the applicable third party.

6. Chargebacks and Payment Disputes

Before initiating a chargeback or external payment dispute, users are expected to first submit a dispute request directly to VisionaryAI at legal@vai-tech.com in accordance with this Policy.

If a user initiates a chargeback or payment dispute in bad faith, after VisionaryAI has already provided the purchased service, or while withholding material facts, VisionaryAI reserves all rights to contest the chargeback and provide relevant records, communications, timestamps, confirmations, and service evidence to the payment processor or financial institution.

7. No Consequential Liability

To the maximum extent permitted by law, where a refund is approved, the refund of the amount actually paid to VisionaryAI for the specific disputed service is the user’s sole and exclusive remedy. VisionaryAI will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, opportunity, data, goodwill, project delay, treatment outcome, or third-party liability arising out of or relating to the disputed transaction.

8. Non-Waivable Rights

This Policy does not limit any rights that cannot lawfully be excluded under applicable law. Where mandatory consumer-protection law gives a user additional rights, those rights will apply to the extent required by law. Ontario law expressly preserves substantive and procedural rights under its consumer protection statute despite contractual waivers, and EU consumer law includes mandatory withdrawal rights for certain distance contracts, subject to specific exceptions.
